Abstract

This study aims to analyze the consistency of acceptance and rejection of cigarette trademark registration by the Ministry of Law and Human Rights (Kemenkumham), particularly in the context of Government Regulation (PP) No. 109 of 2012 concerning Safeguarding Materials Containing Addictive Substances in the Form of Tobacco Products for Health as amended by Government Regulation No. 28 of 2024 concerning Health. Through a normative juridical approach and case study analysis, this study highlights the ambiguity of legal interpretation and potential administrative inconsistencies in the registration of tobacco product trademarks. The findings indicate that the prohibition on the use of certain words such as light, mild, slim, special, premium and others has limited the choice of tobacco product trademark descriptors, resulting in similarities. On the other hand, the trademark registration process has not been fully integrated into the trademark assessment system at Kemenkumham. This study concludes that administrative inconsistencies still occur in Indonesia, and are not fully aligned with international standards such as those applied in ASEAN, European, and American countries. This study recommends the need for regulatory harmonization and the establishment of a transparent, accountable and fair appeals system in trademark registration.
