Di dalam era yang serba globalisasi dimana hampir segala lini membutuhkan jaminan kepastian hukum, masyarakat daerah Indonesia mayoritas masih bersifat gemeinsschaft dengan salah satu ciri tingginya sikap jujur dan saling percaya antara satu dengan yang lain, tidak terkecuali dalam konteks praktik perwakafan. Penelitian yuridis empiris di Kecamatan Selopuro, Kabupaten Blitar, Jawa Timur, Indonesia menunjukkan bahwa praktik perwakafan mayoritas masih sebatas wakaf ucapan lisan antara wakif dan nadzir yang belum sampai pada tahapan ikrar di depan Pejabat Pembuat Akta Ikrar Wakaf.
